Consumer Terms of Service

WhiteFang is a two-sided loyalty platform that enables local merchants ("Merchants") to create and issue digital credit rewards ("Credits") to their customers. As a Consumer, you use WhiteFang to discover participating Merchants on a map, receive Credits into your digital wallet, and redeem those Credits for discounts in-store or online at participating Merchants.

WhiteFang operates the Platform. We do not issue Credits, set their value, or control the terms under which Merchants offer or restrict them. Each Credit is issued by the Merchant who created it.

You must be at least 18 years old to use the Platform. By creating or using an account, you represent and warrant that you meet this requirement.

The Platform is not directed to individuals under 18. If we learn that a minor has created an account, we will terminate it.

3.1 Creating an Account

You may register using your email address and a password of at least 12 characters. You agree to provide accurate, current, and complete information.

3.2 Pre-Created Accounts

A Merchant may add your email address to their customer list before you register. If this occurs, an account will be pre-created for you. You will receive a secure password-setup link to claim and control your account. You are not required to claim such an account.

3.3 Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Contact us immediately at support@whitefang.ai if you suspect unauthorized access.

3.4 One Account Per Person

You may only maintain one Consumer account. Creating multiple accounts to circumvent Credit limits is prohibited.

4.1 What Credits Are

Credits are digital loyalty rewards issued by individual Merchants through WhiteFang. Credits are not issued by WhiteFang and are not a form of currency, gift card, or stored-value instrument issued by us.

4.2 Earning Credits

You earn Credits when a Merchant issues them to you — at the point of sale, via an automated reward (such as a birthday bonus), or when a Merchant adds you to their loyalty program.

4.3 Viewing Your Wallet

Your Wallet displays Credits from all Merchants that have issued Credits to you, including the Merchant name, Credit value, applicable restrictions, and expiration date (if any).

4.4 Redemption

To redeem a Credit in-store, you present a QR code from your Wallet for the Merchant to scan. For online redemptions on Shopify-powered stores, Credits are applied at checkout using a generated discount code.

4.5 No Cash Value

Credits have no cash value and cannot be exchanged for cash or redeemed outside the Platform, regardless of jurisdiction.

4.6 Non-Transferability

Credits are tied to your account and may not be sold, transferred, gifted, or assigned to another person or account.

Each Merchant independently determines the terms under which their Credits may be redeemed. These terms may include:

5.1 Minimum Order Requirements

A Merchant may require a minimum purchase amount before a Credit can be applied.

5.2 Day & Time Restrictions

A Merchant may restrict Credit redemption to specific days of the week or hours of operation.

5.3 Product & Collection Restrictions

A Merchant may limit Credits to specific products, categories, or collections.

5.4 Credit Value Caps

The Credit value applied may be capped or represent a percentage of the order total, as configured by the Merchant.

5.5 Merchant Discretion

Merchants may modify, suspend, or discontinue their Credit programs at any time, subject to applicable law. WhiteFang does not control Merchant Credit terms. Questions about a specific Credit should be directed to the issuing Merchant.

5.6 Exemption from Federal and State Gift Card Laws

Credits issued through WhiteFang are promotional loyalty rewards issued free of charge as part of a Merchant's loyalty program. They are not purchased by you with your own funds and are not general-purpose prepaid cards or stored-value instruments sold at retail. Accordingly, Credits are not subject to the expiration or fee restrictions of the federal Credit CARD Act (15 U.S.C. § 1693l-1), California Civil Code § 1749.5, or substantially similar state gift certificate laws. WhiteFang bears no liability for Credits that expire pursuant to Merchant-configured terms.

6.1 Independent Businesses

Each Merchant is an independent business, not an agent or employee of WhiteFang. Your interactions with a Merchant — including transactions, disputes, or refunds — are between you and that Merchant.

6.2 WhiteFang's Role

WhiteFang provides the technology that enables Merchants to issue Credits and Consumers to discover, receive, and redeem them. WhiteFang is not a party to any transaction between you and a Merchant.

6.3 Merchant Data Access

When you redeem a Credit with a Merchant or are added to a Merchant's customer list, that Merchant may see your name, email address, phone number, and transaction details. This sharing is necessary to operate the loyalty program. See our Privacy Policy for details.

6.4 Merchant Disputes

If you have a dispute about a Credit or redemption experience, your primary recourse is with the issuing Merchant. You may also contact WhiteFang at support@whitefang.ai and we will endeavor to assist where reasonably possible.

The Platform includes a map that displays nearby participating Merchants. To show relevant results:

• We may use your approximate location (derived from your IP address) without requiring GPS permission.

• If you grant GPS permission, we use your precise location only to center the map view.

You are not required to enable GPS. You can disable location access in your device settings at any time. See our Privacy Policy for how location data is handled.

To receive automated Credit rewards (such as birthday bonuses from Merchants), you may provide your birth month and day (MM/DD) in your profile. WhiteFang uses this to trigger automated Credit issuance when enrolled Merchants have active birthday or anniversary automation campaigns.

Providing your birthday is entirely voluntary. If you do not provide it, you will not receive automated birthday or anniversary Credits. Your birth year is not collected or required.

You agree to use the Platform only for its intended purpose: discovering Merchants, managing your Credit wallet, and redeeming Credits. You agree not to:

(a) Use the Platform for any unlawful purpose or in violation of applicable law;

(b) Exploit or manipulate the Credit system, including creating fraudulent redemptions or attempting to extract monetary value from Credits in unauthorized ways;

(c) Create multiple accounts to circumvent Credit limits or restrictions;

(d) Reverse engineer, decompile, or attempt to extract the Platform's source code;

(e) Scrape, harvest, or collect Platform data using automated means;

(f) Interfere with or disrupt Platform systems or infrastructure;

(g) Transmit harmful, malicious, or offensive content;

(h) Impersonate another person or entity.

We endeavor to keep the Platform available and reliable, but we do not guarantee uninterrupted access. We may perform maintenance, modify or discontinue features, or suspend the Platform entirely. If we permanently discontinue the Platform, we will provide reasonable advance notice. WhiteFang is not liable for loss or inconvenience resulting from downtime or feature changes.

The Platform integrates with third-party services including:

Shopify: Consumers redeeming Credits at Shopify-powered Merchants interact with Shopify's checkout infrastructure. Your use of Shopify's checkout is subject to Shopify's own terms.

Other POS Systems: Merchants may use Toast, Square, Clover, or Lightspeed. WhiteFang is not responsible for third-party POS failures or errors.

WhiteFang does not control and is not responsible for the content, policies, or practices of third-party services.

12.1 WhiteFang's Property

All content, software, branding, and materials on the Platform are owned by or licensed to WhiteFang. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial purposes in accordance with these Terms.

12.2 No Unauthorized Use

You may not copy, reproduce, distribute, or commercially exploit any portion of the Platform without our prior written consent.

12.3 Your Content

You retain ownership of content you submit (such as profile information). By submitting content, you grant WhiteFang a non-exclusive, worldwide, royalty-free license to use, display, and process that content solely to operate the Platform.

13.1 By You

You may delete your account at any time by contacting support@whitefang.ai. Upon deletion, your Credits are permanently forfeited and cannot be recovered.

13.2 By WhiteFang

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if we discontinue the Platform. Upon termination, your right to use the Platform ceases immediately.

13.3 Effect of Termination

All Credits in your wallet are forfeited on termination. Credits have no cash value and are not refundable.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WHITEFANG DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WHITEFANG MAKES NO WARRANTY THAT: (A) THE PLATFORM WILL BE ERROR-FREE OR UNINTERRUPTED; (B) CREDITS WILL BE HONORED BY ANY PARTICULAR MERCHANT; (C) MAP OR LOCATION DATA WILL BE ACCURATE; OR (D) ANY DEFECT WILL BE CORRECTED.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WHITEFANG AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

(A) ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES;

(B) LOSS OF CREDITS, REWARDS, OR DISCOUNTS;

(C) MERCHANT REFUSAL TO HONOR CREDITS;

(D) LOSS OF DATA OR UNAUTHORIZED ACCOUNT ACCESS.

WHITEFANG'S TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF (I) $100 OR (II) THE TOTAL AMOUNT PAID BY YOU TO WHITEFANG IN THE TWELVE MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow certain liability exclusions. In those jurisdictions, the above limitations apply to the fullest extent permitted by applicable law.

You agree to indemnify, defend, and hold harmless WhiteFang and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any applicable law or third-party right; or (d) any content you submit through the Platform.

17.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict-of-law principles.

17.2 Informal Resolution

Before initiating formal proceedings, you agree to contact us at support@whitefang.ai and give us at least 30 days to resolve the dispute informally.

17.3 Binding Arbitration

If informal resolution fails, any dispute arising from or relating to these Terms or the Platform shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Judgment on the award may be entered in any court with jurisdiction.

17.4 Class Action Waiver

YOU AND WHITEFANG EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE ACTION.

17.5 Exceptions

Either party may seek injunctive or equitable relief in a court of competent jurisdiction for matters involving intellectual property infringement.

Depending on where you live, you may have additional rights under state or national privacy law. These rights are described in detail in our Privacy Policy. A summary:

California (CCPA/CPRA)

California residents have the right to know what personal information is collected, request deletion, correct inaccurate data, opt out of the sale or sharing of personal information (WhiteFang does not sell personal information), and not be discriminated against for exercising these rights.

Virginia (VCDPA)

Virginia residents have the right to access, correct, delete, and obtain a portable copy of their personal data, and to opt out of certain processing.

Colorado (CPA)

Colorado residents have rights similar to Virginia, including the right to opt out of profiling used to make significant decisions.

Connecticut (CTDPA)

Connecticut residents have the right to access, correct, delete, and obtain a copy of their personal data.

Texas (TDPSA)

Texas residents have the right to access, correct, delete, and obtain a portable copy of their personal data.

Nevada (SB220)

Nevada residents may opt out of the sale of their personal information. WhiteFang does not sell personal information.

Oregon (OCPA)

Oregon residents have the right to access, correct, delete, and obtain a copy of their personal data.

European Union & United Kingdom (GDPR / UK GDPR)

If you are located in the EU or UK, you have rights under the GDPR or UK GDPR including access, rectification, erasure, restriction, portability, and the right to object to processing. You also have the right to lodge a complaint with your local supervisory authority. WhiteFang's primary operations are in the United States; if you access the Platform from the EU or UK, your data is processed in the US as described in our Privacy Policy.

To exercise any of the above rights, see our Privacy Policy or contact support@whitefang.ai. These Terms do not limit or waive any rights granted to you by applicable law.

We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date and, where appropriate, display an in-app notice. Continued use of the Platform after the effective date constitutes your acceptance of the updated Terms. If you do not agree, you must stop using the Platform.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and WhiteFang regarding your use of the Platform as a Consumer. They supersede all prior agreements, representations, and understandings.
