By creating an account, accessing, or using the Services, you confirm that you have read, understood, and agree to these Terms. If you do not agree, you must not use the Services. Your continued use after any update to these Terms constitutes acceptance of the revised version.

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services. By using the Services, you represent that you meet this requirement. We do not knowingly permit use of the platform by minors.

• ●You agree to provide accurate, complete, and up-to-date information at registration and keep it current.
• ●You are responsible for maintaining the confidentiality of your account credentials.
• ●You are responsible for all activities that occur under your account.
• ●Notify us immediately at support@whitefang.ai if you suspect unauthorized access to your account.

You agree to use the Services only for lawful purposes and in accordance with these Terms. You shall not:

• ●Violate any applicable laws or regulations
• ●Infringe upon the intellectual property rights of any party
• ●Reverse engineer, decompile, or attempt to extract source code from the platform
• ●Interfere with or disrupt the Services, servers, or networks connected to the Services
• ●Transmit harmful, malicious, or fraudulent content
• ●Attempt to circumvent credit limits, expiration dates, or platform restrictions
• ●Create multiple accounts to abuse promotional credits or platform features

Credit issuance: Merchants are solely responsible for the credits they issue, including their value, expiration dates, and any restrictions. Credits, once issued to a consumer, create a commitment by the merchant to honor the redemption at their point of sale.

POS integration: By connecting a point-of-sale system (e.g., Shopify, Toast), you authorize WhiteFang to access that system's APIs as described in our Privacy Policy for the purpose of creating discounts, reading orders, and processing credit redemptions.

Consumer data: Merchants who receive consumer data through the platform (names, emails, credit history) agree to use that data only for legitimate business purposes related to their participation on WhiteFang, and to handle it in compliance with applicable privacy laws. Merchants may not sell, transfer, or use consumer data for purposes unrelated to the WhiteFang platform without the consumer's explicit consent.

Account deletion: Merchants may request account deletion from the Settings page. Deletion requests carry a 30-day grace period during which the request can be cancelled. All active consumer credits are cancelled immediately upon a deletion request. Hard deletion occurs after the grace period.

Credits: Digital credits issued to you are specific to the issuing merchant, non-transferable, and have no cash value. Credits expire on the date set by the merchant at issuance and cannot be extended. Unused credits are forfeited upon expiration or account deletion.

Account deletion: You may request account deletion at any time via Profile → Security → Delete Account. The request carries a 30-day grace period during which your account is deactivated and you may cancel the request. Hard deletion of your profile, credit wallet, and activity history occurs after the grace period expires and cannot be undone.

• ●Certain merchant features may require a paid subscription.
• ●Fees, billing cycles, and payment terms will be disclosed at the time of purchase.
• ●All payments are non-refundable unless otherwise stated or required by law.
• ●We reserve the right to change pricing with reasonable advance notice.
• ●Subscriptions are managed through Shopify Billing for Shopify-connected merchants.

• ●All content, software, and materials provided by WhiteFang.ai are owned by or licensed to us.
• ●You are granted a limited, non-exclusive, non-transferable license to use the Services for their intended purpose.
• ●You may not copy, distribute, or create derivative works from platform materials without prior written consent.
• ●Merchant-uploaded content (logos, business descriptions) remains owned by the merchant. By uploading it, you grant WhiteFang a limited license to display it within the platform.

Your use of the Services is governed by our Privacy Policy, which is incorporated into these Terms by reference. Our technical and operational security practices are described in our Written Information Security Program. By using the Services, you acknowledge that you have read and understand both documents.

• ●We do not guarantee that the Services will be uninterrupted, error-free, or available at all times.
• ●We may modify, suspend, or discontinue any part of the Services at any time.
• ●We will make reasonable efforts to notify users of planned downtime or significant changes.

The Services integrate with third-party platforms including Shopify and Toast. We are not responsible for the availability, content, policies, or practices of third-party providers. Your use of third-party services is subject to their respective terms and privacy policies.

We may suspend or terminate your access to the Services at our discretion if you violate these Terms or for any other reason with reasonable notice, except where immediate action is necessary to protect the platform or other users. Upon termination, your right to use the Services will immediately cease. Sections that by their nature should survive termination (intellectual property, liability, indemnification, governing law) will survive.

The Services are provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will meet your requirements or that any errors will be corrected.

To the fullest extent permitted by applicable law, WhiteFang.ai and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, goodwill, or business opportunities, arising out of or in connection with your use of the Services.

Our total aggregate liability to you for any claims arising under these Terms shall not exceed the greater of (a) the amount you paid to WhiteFang in the 12 months preceding the claim, or (b) one hundred US dollars ($100).

You agree to indemnify, defend, and hold harmless WhiteFang.ai and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Massachusetts, and you consent to personal jurisdiction in those courts.

Before initiating any formal dispute, you agree to contact us at support@whitefang.ai and attempt to resolve the matter informally for at least 30 days.

We may update these Terms from time to time. We will notify you of material changes by posting a notice within the app or by email. The revised Terms will be effective on the date indicated at the top of this page. Continued use of the Services after the effective date constitutes acceptance.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and WhiteFang.ai regarding your use of the Services and supersede all prior agreements and understandings.
